From 1 July 2026, real estate agents, agencies, and conveyancers will be designated reporting entities under the AML/CTF Act. This means new legal obligations: registering with AUSTRAC, implementing an AML/CTF program, conducting customer due diligence (know your customer checks), monitoring transactions, and reporting suspicious matters and threshold transactions to AUSTRAC.
These changes are significant. Real estate is recognised globally as a high-risk sector for money laundering, with property transactions often used to place, layer, or integrate proceeds of crime. Australia’s reforms bring us in line with international standards set by the Financial Action Task Force (FATF), and non-compliance can carry serious civil and criminal penalties.
